M&T Bank seeks damages from Samarian Capital and owner, former account holders

PITTSBURGH — A New York bank is suing Samarian Capital LLC and Michael A. Dolan II, former account holders at the institution, citing alleged breach of contract, fraud and negligent misrepresentation.

Manufacturers and Traders Trust Company a/k/a M & T Bank filed a complaint on March 15 in the U.S. District Court for the Western District of Pennsylvania alleging that the defendants failed to make any settlement payments to the plaintiff stemming from money owed on a business account.

According to the complaint, the plaintiff alleges that it sustained financial damages. The plaintiff holds Samarian Capital and Dolan responsible because the defendants allegedly engaged in misrepresentations in their dealings with the bank.

The plaintiff seeks compensatory and consequential damages that exceed $89,894.33 plus interest, court costs, punitive damages and any further relief the court grants. The plaintiff is represented by William E. Kelleher Jr. and Helen Sara Ward of Cohen & Grigsby PC in Pittsburgh.
