PHILADELPHIA — A Downington man is suing The Lincoln National Life Insurance Co., citing alleged breach of contract for not paying him all benefits owed.

Wayne Buckwalter, who is an attorney with the firm Cohen Seglias Pallas Greenhall & Furman, filed a complaint on April 5 in the U.S. District Court for the Eastern District of Pennsylvania against the Radnor-based insurance company refused to pay plaintiff's claim for benefits.

According to the complaint, the plaintiff alleges that he sustained damages from being paid partial payments of his benefits. The plaintiff holds the insurance company responsible because it allegedly failed to consider the medical history of the plaintiff when making its decision and relied only on its medical review.

The plaintiff seeks judgment against the defendant to award the plaintiff the full and complete payment of disability benefits, interest, court costs and any further relief this court grants. He is represented by Michael J. Burns of Bowen & Burns in Southampton.
