Insurance company files suit against Lowe's for alleged damage to insured's home

PHILADELPHIA - An insurance company is suing Lowe's Companies Inc. on behalf of a Philadelphia family, citing alleged liability and negligence for damage done by a product from a Lowe's retail store.

The Philadelphia Contributionship Insurance Company, on behalf of Niusha Houshmandaraghi, filed a complaint on April 10 in the U.S. District Court for the Eastern District of Pennsylvania against Lowe's, alleging it failed to properly check a dehumidifier for defects before selling it to consumers.

According to the complaint, the plaintiff alleges it sustained damages due to damage done to the insured's property. The insurer holds Lowe's responsible because its product allegedly caused a fire to start in the property of the Houshmandaraghi family, causing severe damage.

The plaintiffs seek judgment against the defendant in an amount that exceeds $500,000 plus interest, damages and any further relief this court grants. They are represented by Patrick A. Hughes of De Luca Levine LLC in Blue Bell.
