PHILADELPHIA — A Delaware woman is suing National Railroad Passenger Corporation (Amtrak), citing alleged hostile work environment, insufficient measures taken to prevent injuries, liability and negligence.
Rosa Nesmith filed a complaint on April 17 in the U.S. District Court for the Eastern District of Pennsylvania against Amtrak alleging that the employer failed to provide a safe working environment to the plaintiff.
According to the complaint, the plaintiff alleges that she sustained physical injuries when she tripped and fell over wires protruding from underneath a conveyor belt while performing her duties as a materials control clerk in the defendant's Bear, Delaware, facility. The plaintiff holds the defendant responsible because Amtrak allegedly failed to secure the wires within its workplace to make sure that its employees including the plaintiff were safe.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds $150,000. She is represented by Michael J. Olley and Lawrence A. Katz of Coffey Kaye Myers & Olley in Bala Cynwyd.
