PHILADELPHIA — A Cornwall man is suing Diamond Scaffold Services Group Inc. and Diamond Scaffold Builders LLC, an Alabama business, citing alleged breach of contract for failing to pay an agreed-upon settlement to him for injuries he suffered after falling off scaffolding.
Arnold McElroy filed a complaint on April 24 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they failed to pay the plaintiff over $4 million based on their contractual agreement.
According to the complaint, the plaintiff alleges that he was injured from falling from scaffolding that was erected by the defendants while working at the Philly Shipyard Inc. building location. The plaintiff holds the defendants responsible because they allegedly, in December 2016, entered into an agreement to pay the plaintiff provided he dropped all actions against them, but they have failed to pay.
The plaintiff seeks judgment against the defendant in the amount of $4,400,000, plus all other damages, interest, court costs and any further relief this court grants. He is represented by Brian S. Chacker of Gay Chacker & Mittin P.C. in Philadelphia.
