Xodus Medical says Florida company sells infringing surgical device

PITTSBURGH — A New Kensington medical device company is suing The Soule Co. d/b/a Soule Medical, a Florida corporation, citing alleged patent infringement.

Xodus Medical Inc., Alessio Pigazzi and Glenn Keilar filed a complaint on May 10 in the U.S. District Court for the Western District of Pennsylvania alleging that the defendant sells medical products that infringe plaintiff's patents.

According to the complaint, the plaintiffs allege that they were damaged from having their patent infringed. The plaintiffs hold Soule Medical responsible because the defendant allegedly manufactures and offers for sale certain products, which position and stabilize patients during surgery, that infringe at least one claim of plaintiff's patents.

The plaintiffs request a trial by jury and seek injunction against the defendant, treble damages, court costs and any further relief this court grants. They are represented by Kent E. Baldauf Jr., Thomas C. Wolski and David A. Dumont of The Webb Law Firm in Pittsburgh.
