Aqua Pharmaceuticals says it was grossly overcharged for processing fees by New York pharmacy

PHILADELPHIA — A pharmaceutical company is suing Park Irmat Drug Corp d/b/a Irmat Pharmacy, of New York, alleging it grossly overcharged it for processing and charge-back fees.

Aqua Pharmaceuticals LLC, of Chester County, filed a complaint on May 17 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the defendant routinely overbilled the plaintiff for amounts it was allowed to recoup under an agreement. The plaintiff had entered into a contract with the defendant to sell it pharmaceutical products.

According to the complaint, the plaintiff alleges that it was financially damaged from being overbilled by, the complaint states, "many millions of dollars." The plaintiff holds Irmat Pharmacy responsible because the defendant allegedly breached its agreement with the plaintiff by billing the plaintiff more than what was agreed.

The plaintiff requests a trial by jury and seeks damages that exceed $75,000, punitive damages, interest and court costs. It is represented by James L. Beausoleil Jr. and Jeffrey S. Pollack of Duane Morris LLP in Philadelphia.
