Suit alleges Bayer contraceptive is defective

PHILADELPHIA — A consumer is suing Bayer Healthcare Pharmaceuticals Inc. and related companies, alleging that insufficient measures were taken to prevent injuries, liability and negligence resulting from use of a contraceptive product.

Jessica Bihler filed a complaint on June 15 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they manufactured and sold a defective product called Mirena.

According to the complaint, the plaintiff alleges that she was seriously injured from using Mirena. The plaintiff holds Bayer Healthcare Pharmaceuticals Inc., Bayer Pharma AG and Bayer OY responsible because the defendants allegedly failed to warn the plaintiff regarding the potential harmful effects of Mirena.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, court costs and any further relief the court grants. She is represented by Derek T. Braslow of Pogust Braslow Millrood, LLC in Conshohocken , Penn.
