1st Priority Elevator Co. alleged to owe more than $30,000 in contributions

PHILADELPHIA – A South Holland, Illinois employer is alleged to have failed to pay contributions to labor union funds.

Trustees of the National Elevator Industry Pension, Health Benefit, Educational, Elevator Industry Work Preservation Funds, Elevator Constructors Annuity and 401(k) retirement plan filed a complaint on July 12 in the U.S. District Court for the Eastern District of Pennsylvania against 1st Priority Elevator Co. and Mauline Williams citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that Trustees of the National Elevator Industry Pension, Health Benefit, Educational, Elevator Industry Work Preservation Funds, Elevator Constructors Annuity and 401(k) retirement plan sustained financial damages due to unpaid contributions. The plaintiff holds 1st Priority Elevator Co. and Williams responsible because the defendants allegedly failed to pay the amount required by the bargaining agreement.

The plaintiff seeks $37,627.17 in contributions and interest, liquidated damages, court costs and any further relief the court grants. They are represented by Robert P. Curley and David D. Capuano of O'Donoghue & O'Donoghue LLP in Philadelphia.
