Workers hired by Strom Engineering during ATI lockout allege they were not paid overtime

ERIE – A North Carolina man and a California man who temporarily worked at a Brackenridge facility allege they were not paid overtime wages.

Ralph Smith and Ignatius Harris filed a complaint on behalf of themselves all others similarly situated on July 10 in the U.S. District Court for the Western District of Pennsylvania against Allegheny Technologies Inc. and Strom Engineering Corp. citing the Fair Labor Standards Act.

According to the complaint, Storm provided staffing for strike and lockout replacement labor for unionized employees at ATI in 2015. The plaintiffs hold Allegheny Technologies Inc. and Strom Engineering Corp. responsible because the defendants allegedly failed to pay overtime at a rate of time-and-one-half and required them to work off the clock.

The plaintiffs request a trial by jury and seek pay damages, unpaid overtime compensation, interest, liquidated damages, court costs and any further relief the court grants. They are represented by Shanon J. Carson and Sarah R. Schalman-Bergen of Berger & Montague PC in Philadelphia.
