Elite Linen LLC faces suit from labor secretary over alleged payment practices

PHILADELPHIA – A Philadelphia limited liability company engaged in the commercial linen business is alleged to have failed to pay employees overtime wages.

Secretary of Labor for the United States of Department of Labor R. Alexander Acosta filed a complaint on Aug. 3 in the U.S. District Court for the Eastern District of Pennsylvania against Elite Linen LLC, doing business as Elite Linen/Fawn Services, and Jonathan Levinson citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that the defendants failed to pay their employees who worked more than 40 hours per workweek overtime pay at a rate of time-and-one-half of their regular rate. The suit also states that the defendants failed to keep accurate time records

The plaintiff seeks injunction against the defendants, liquidated damages, interest, court costs and any further relief the court grants. He is represented by Jennifer L. Bluer and Andrea Luby of Office of the Solicitor in Philadelphia.
