ERIE – Three former servers of a Clearfield restaurant allege that they were not paid a minimum wage during their employment.
Rachael Bailey, Hillary Maguire and Diane Knepp filed a complaint on behalf of all others similarly situated on Aug. 4 in the U.S. District Court for the Western District of Pennsylvania against Denny's Beer Barrel Pub Inc., Dennis F. Liegey Sr. and Dennis F. Liegey Jr. citing the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law.
According to the complaint, the plaintiffs allege that they were paid less than the minimum wage of $7.25 per hour during their employment with the defendants.
The plaintiffs hold Denny's Beer Barrel Pub Inc., Dennis F. Liegey Sr. and Dennis F. Liegey Jr. responsible because the defendants allegedly improperly utilized a tip credit and did not pay the plaintiffs for overtime work.
The plaintiffs request a trial by jury and seek damages, interest, court costs and any further relief the court grants. They are represented by Derrek W. Cummings, Larry A. Weisberg and Steve T. Mahan of McCarthy Weisberg Cummings PC in Harrisburg.
