FBCS Inc. allegedly failed to disclose statute of limitations had expired on debt

PHILADELPHIA - A Texas man has filed a lawsuit against a Hatboro-based debt collector over allegations that a collection letter omitted a material disclosure.

Timothy Wiseman filed a complaint in the U.S. District Court for the Eastern District of Pennsylvania Sept. 11 against FBCS Inc., alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the defendant sent the plaintiff a collection letter in September 2016 outlining several payment options to settle an alleged debt.

The plaintiff holds FBCS Inc. responsible because the defendant allegedly failed to convey to the plaintiff that the statute of limitations on the purported debt had expired.

The plaintiff seeks actual damages, statutory damages, court costs and any further relief the court grants. He is represented by Antranig Garibian of Garibian Law Offices PC in Philadelphia.
