Consumer claims National Gas & Electric's telemarketing calls were unlawful

PHILADELPHIA - A Houston energy services company is accused of illegal telemarketing by a Pennsylvania resident.

James Everett Shelton filed a complaint on behalf of himself and all persons and entities similarly situated in the U.S. District Court for the Eastern District of Pennsylvania Sept. 11 against National Gas & Electric LLC, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges he received automated telemarketing calls from the defendant despite having no business relationship with it. The suit states the plaintiff received a call Aug. 18 and that his number was listed on the National Do Not Call Registry.

The plaintiff holds National Gas & Electric LLC responsible because the defendant allegedly contacted the plaintiff without his consent.

The plaintiff requests a trial by jury and seeks to enjoin the defendant, damages, court costs and any further relief the court grants. He is represented by Clayton S. Morrow of Morrow & Artim PC in Pittsburgh.
