PHILADELPHIA - A New Philadelphia man alleges a disability benefit provider unlawfully denied him short-term disability benefits.
John E. Shamonsky filed a complaint in the U.S. District Court for the Eastern District of Pennsylvania Sept. 11 against Liberty Life Assurance Co. of Boston and Carpenter Technology Co. STD Plan, alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff was unable to continue working after Sept. 20, 2016 because of Lyme disease. He alleges he applied for short-term disability benefits in December 2016 but instead was approved for long-term disability benefits in March.
The plaintiff holds Liberty Life Assurance Co. of Boston and Carpenter Technology Co. STD Plan responsible because the plaintiff alleges he has not received the disability benefits he is entitled to.
The plaintiff seeks payment of all past-due benefits, all contributions, interest, court costs and any further relief the court grants. He is represented by Gregory G. Paul of Morgan & Paul PLLC in Pittsburgh.
