ABC Capital Investments alleges entities poached information

PHILADELPHIA – A Philadelphia company claims that former clients poached trade secrets.

ABC Capital Investments LLC filed a complaint on Aug. 7 in the U.S. District Court for the Eastern District of Pennsylvania against BTV Phil LLC, Sienna Ventures LLC, SVPA Phil I LLC, David Gabbay and Franco Pacelli citing the Pennsylvania Proprietary Trade Secrets Act and other counts.

According to the complaint, the plaintiff alleges that the defendants are former clients and "engaged in numerous detailed, complex real estate acquisition, development and rental transactions through plaintiff."

The plaintiff holds the defendants responsible because the defendants allegedly "were, upon information and belief, surreptitiously identifying proprietary business models, trade secrets, customers lists, key employees or subcontractors and/or laborers so that they could poach, steal all said concepts and employees" for their own benefit, the complaint states.

The plaintiff requests a trial by jury and seeks injunctive relief, damages, statutory violations of more than $125,000 and any further relief the court grants. It is represented by David T. Shulick of Shulick Law in Philadelphia.
