Company claims KEB Hana Bank USA provided false, misleading appraisal

SCRANTON - A Mountainhome limited liability company alleges a bank engaged in deceptive business practices regarding a mortgage.

Red Mansion LLC, doing business as Naomi Village Resort, filed a complaint in the U.S. District Court for the Middle District of Pennsylvania Sept. 11 against KEB Hana Bank USA National Association, formerly BNB Hana Bank National Association, alleging negligence, breach of contract and other counts.

According to the complaint, the plaintiff borrowed $1.6 million in 2009 from BNB Bank National Association for the Mountainhome property. The suit states the bank had appraised the property at $2.6 million.

The suit also states that in 2015 the defendant filed a complaint in mortgage foreclosure against the plaintiff, and the property was sold at a public sale for $325,000. In July 2014, the plaintiff alleges the defendant claimed the market value of the property was $515,000.

The plaintiff holds the defendant responsible because the defendant allegedly improperly characterized the value of the property and provided the plaintiff with false and misleading appraisals.

The plaintiff seeks judgment against the defendant for an amount of more than $75,000; compensatory, special, general and punitive damages; interest; court costs; treble damages; and any further relief the court grants. It is represented by Andrew J. Katsock III in Wilkes-Barre.
