HARRISBURG – An insurance company is seeking damages after a fire at a Hanover property.
State Farm Fire & Casualty Co., as subrogee of Alan and Heather Shaw, filed a complaint on Sept. 29 in the U.S. District Court for the Middle District of Pennsylvania against Burkentine & Sons Builders Inc. and Stone Ridge Development Corp. alleging negligence, breach of contract and other counts.
According to the complaint, the Shaw's property sustained damages as the result of the fire that erupted at the property on Jan. 19, 2016, due to the improper design and construction of the chimney chase area. The suit states the defendants were the property's developer and general contractor.
The plaintiff holds Burkentine & Sons Builders Inc. and Stone Ridge Development Corp. responsible because the defendants allegedly failed to supervise their employees during the installation of the insulation of the chase and flue areas.
The plaintiff seeks judgment against the defendant in an amount of more than $250,000 plus interest, court costs, delay damages, and any further relief the court grants. It is represented by Daniel J. de Luca of de Luca Levine LLC in Blue Bell.
