Delaware County woman claims debt collector withdrew funds from bank account without permission

PHILADELPHIA — A Delaware County woman is suing a collection agency, citing alleged misrepresentation in debt collection.

Antoinette Boyce filed a complaint Oct. 4 in the U.S. District Court for the Eastern District of Pennsylvania against TekCollect Inc., alleging it collected money from the plaintiff that it was not authorized to collect based on an agreement.

According to the complaint, the plaintiff alleges that in 2016, she sustained financial damages after the defendant withdrew funds from her bank account without her consent, which did not abide by an installment agreement she made with the defendant. The plaintiff holds TekCollect responsible because the withdraw caused overdraft charges to be levied by her bank.

The plaintiff requests a trial by jury and seeks actual damages, treble damages, court costs and any further relief this court grants. She is represented by Michael P. Forbes of Law Office of Michael P. Forbes P.C. in Wayne.
