PHILADELPHIA – A Philadelphia woman alleges her former medical center employer terminated after she was approved for intermittent medical leave.
Nancy Hernandez filed a complaint on Oct. 2 in the U.S. District Court for the Eastern District of Pennsylvania against Temple University Hospital alleging violation of the Family and Medical Leave Act.
According to the complaint, the plaintiff was hired by the defendant in January 2005 as a medical secretary, left in 2006, and was rehired in 2007. The suit states in 2013, 2014, 2015 and 2016, she applied for intermittent FMLA leave to care for her minor daughter's medical conditions. She alleges she was terminated on Sept. 30, 2016, because of her request for leave.
The plaintiff requests a trial by jury and seeks compensatory damages, liquidated damages and any further relief the court grants. She is represented by David M. Koller of Koller Law LLC in Philadelphia.
