Developers Surety claims Pennsylvania company, others failed to reimburse company for loss

PITTSBURGH — A California company is suing a Pennsylvania corporation and individuals, citing alleged breach of contract.

Developers Surety and Indemnity Co. filed a complaint Oct. 3 in the U.S. District Court for the Western District of Pennsylvania against Clear Span Construction Products LLC, Matthew G. Williams, Colleen M. Williams, Nate Kurek and Christine A. Kurek, alleging that they failed to indemnify and reimburse the plaintiff based on their agreement.

According to the complaint, the plaintiff alleges that Developers Surety and Indemnity sustained financial damages as the result of the breach of an indemnity agreement. The plaintiff holds the defendants responsible because they allegedly failed to comply with their obligation with the plaintiff by failing to reimburse the company for their loss.

The plaintiff seeks damages and losses, all expenses, future expenses and legal fees, interest and any further relief this court grants. They are represented by W. Alan Torrance Jr. of Dickie, McCamey & Chilcote P.C. in Pittsburgh.
