PHILADELPHIA – Two commercial truck drivers allege they were misclassified and not paid a minimum wage.
Gale Carter and Forbes Hayes filed a complaint on behalf of themselves and those similarly situated on Oct. 11 in the U.S. District Court for the Eastern District of Pennsylvania against Paschall Truck Lines Inc., ECN Financial LLC, PNC Equipment Finance LLC and John Does 1-20 citing the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege they were classified as independent contractors erroneously during their employment with the defendants.
The plaintiffs hold Paschall Truck Lines Inc., ECN Financial LLC, PNC Equipment Finance LLC and John Does 1-20 responsible because the defendants allegedly failed to provide adequate compensation to the plaintiffs.
The plaintiffs seek to prohibit the defendants from continuing their policies and practices that violate the federal law; compensate and reimburse the plaintiffs; award all pay and benefits to the plaintiff; liquidated damages; statutory and/or punitive damages; court costs and any further relief the court grants.
