PHILADELPHIA – An adult film producer alleges an individual has illegally downloaded and distributed its films online.

Strike 3 Holdings LLC filed a complaint on Oct. 26 in the U.S. District Court for the Eastern District of Pennsylvania against John Doe subscriber assigned IP address 71.224.136.32 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it was damaged as the result of 52 of its adult motion pictures being reproduced and distributed without its consent. The plaintiff holds John Doe subscriber assigned IP address 71.224.136.32 responsible because the defendant allegedly used the BitTorrent file distribution network to download and distribute plaintiff's motion pictures. The plaintiff alleges that geolocation technology has traced the defendant's IP address to a physical location in this district.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's works, order the defendant to delete and permanently remove the digital media files relating to the plaintiff, statutory damages, court costs and any further relief the court grants. It is represented by Andrew W. Bonekemper and Christian Moffitt of Fox Rothschild LLP in Blue Bell.
