PHILADELPHIA – A Philadelphia registered investment adviser alleges that a California company is unlawfully using its trademark.

Clark Capital Management Group Inc. filed a complaint on Oct. 26 in the U.S. District Court for the Eastern District of Pennsylvania against Pacific Life Insurance Co. alleging trademark infringement.

According to the complaint, the plaintiff uses its Navigator mark for its financial services and products, which was registered in 1991. The suit states the defendant is using the Pacific Navigator mark for financial and investment services.

The plaintiff alleges that the defendant's mark is likely to cause confusion and cause harm to its reputation and goodwill.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's mark; order the defendant to deliver up for destruction all infringing materials; pay damages suffered by the plaintiff; compensatory; incidental and consequential damages; enhanced, treble and/or punitive damages; court costs and any further relief the court grants.
