PITTSBURGH – A West Homestead construction company is alleged to have failed to pay contributions to a union's funds per the terms of a bargaining agreement.
The board of trustees of Cement Masons' Local 526 Combined Funds Inc. filed a complaint on Nov. 2 in the U.S. District Court for the Western District of Pennsylvania against R & B Contracting & Excavation Inc., William Rodgers, Richard Roscoe, Daniel Amato and Does 1-50 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that it has not received payments from R & B Contracting & Excavation Inc. for work done by its employees for June to September 2017. The plaintiff alleges that it is owed $34,193.34 for fringe benefits, dues and payroll.
The plaintiff seeks money judgment in the amount of $34,193.34 plus costs, fringe benefits owed, administration and audit costs, interest, court costs and any further relief the court grants.
