Greater Pennsylvania Carpenters' Medical Plan seeks reimbursement for benefits from divorced couple

JOHNSTOWN – A West Decatur man and Woodland woman are alleged to have failed to notify a medical plan that they divorced.

Board of trustees of the Greater Pennsylvania Carpenters' Medical Plan filed a complaint on Nov. 6 in the U.S. District Court for the Western District of Pennsylvania against Steven L. Uncles and Elizabeth G. Uncles citing the Employee Retirement Income Security Act.

According to the complaint, Steven Uncles was a participant in the plaintiff's plan. The suit states the defendants divorced in 2014 and that after the divorce, Elizabeth G. Uncles was no longer covered by the plaintiff's plan under its terms. The plaintiff alleges the defendants failed to notify it of the divorce and that it continued to pay benefits to Elizabeth Uncles through October 2016 in the amount of $17,141.78.

The plaintiff holds Steven L. Uncles and Elizabeth G. Uncles responsible because the defendants allegedly have not reimbursed it for the benefits it paid to Elizabeth Uncles.

The plaintiff seeks judgment against the defendant for the amount of not less than $17,141.78 plus interest, court costs and any further relief the court grants. They are represented by Stephen J. O'Brien and Andrew L. Ciganek of Stephen J. O’Brien & Associates in Pittsburgh.
