EMC Outdoor LLC alleges former employee misappropriated trade secrets

PHILADELPHIA – A Newtown Square media placement and planning agency has filed suit against a former employee after she allegedly failed to return company equipment.

EMC Outdoor LLC filed a complaint on Nov. 16 in the U.S. District Court for the Eastern District of Pennsylvania against Jennifer Stuart alleging conversion of confidential information and trade secrets and physical property, misappropriation of trade secrets and other counts.

According to the complaint, the plaintiff alleges that the defendant failed to return two computers she received during her employment with EMC and refused to permit the plaintiff to delete confidential information from her personal devices. The plaintiff alleges it believes the defendant has used and disclosed trade secrets to competitors after her employment was terminated.

The plaintiff seeks order the defendant to return all EMC computers, documents, information and other confidential materials to the plaintiff within 48 hours; enjoin the defendant from using and disclosing any of the plaintiff's trade secrets; compensatory damages; statutory damages; court costs; punitive and exemplary damages; and any further relief the court grants.
