PITTSBURGH – A Cranberry Township business is alleged to have failed to pay overtime wages.
Robert P. Cortese filed a complaint on behalf of himself and similarly situated employees on Nov. 17 in the U.S. District Court for the Western District of Pennsylvania against PPG Architectural Coatings N.A. alleging violation of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.
According to the complaint, the plaintiff alleges that he worked for the defendant from March 2004 to October 2017. He alleges he worked for more than 40 hours per week but was not paid any overtime compensation.
The plaintiff holds PPG Architectural Coatings NA responsible because the defendant allegedly misclassified the plaintiff as exempt from overtime pay.
The plaintiff requests a trial by jury and seeks compensatory damages equal to the unpaid overtime compensation owed to the plaintiff, liquidated damages, interest, court costs and any further relief the court grants. He is represented by Joseph H. Chivers of Employment Rights Group in Pittsburgh and John R. Linkosky of John Linkosky & Associates in Carnegie.
