Ohio parents allege infant was injured during delivery at UPMC Horizon hospital

PITTSBURGH – An Ohio couple alleges that negligence during the delivery of their minor child caused severe brain trauma and permanent brain damage.

Rachel Hutchings and Rusty Hutchings Jr., individually and as parents and natural guardians on behalf of ARH, a minor filed a complaint on Nov. 30 in the U.S. District Court for the Western District of Pennsylvania against Michelle L. Wright, D.O.; UPMC Horizon Shenango Valley; and University of Pittsburgh Physicians alleging negligence.

According to the complaint, Rachel Hutchings was under care of Wright and present to UPMC Horizon in Farrell for labor and delivery on April 21, 2016. The suit states that a vacuum extraction was used during delivery and that in January 2017, ARH was diagnosed with cerebral palsy.

The plaintiffs hold Wright, UPMC Horizon Shenango Valley and University of Pittsburgh Physicians responsible because the defendants allegedly inappropriately attempted repeated vacuum extraction and caused ARH to sustain brain damage through the excessive attempts at vacuum extraction delivery.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount that exceeds the arbitration limits of this court, interest and court costs. They are represented by Thomas R. Kline, Dominic C. Guerrini and Mark S. Polin of Kline & Specter in Philadelphia.
