READING – A nonprofit alleges the city of Philadelphia failed to timely provide documents it requested.

Disability Rights Pennsylvania filed a complaint on Dec. 8 in the U.S. District Court for the Eastern District of Pennsylvania against the city of Philadelphia citing the Protection and Advocacy for Individuals with Mental Illness Act and the Developmental Disabilities Assistance and Bill of Rights Act.

According to the complaint, the plaintiff requested the records of five young individuals with disabilities to the defendant's Department of Human Services. The plaintiff alleges the defendant failed to timely provided the requested records and that it intends to redact any documents it provides.

The plaintiff holds the city of Philadelphia responsible because the defendant's actions allegedly violate the Protection and Advocacy for Individuals with Mental Illness Act and the Developmental Disabilities Assistance and Bill of Rights Act.

The plaintiff seeks declaratory relief and injunctive relief and any further relief the court grants plus court costs. It is represented by Koert Wehberg and Robin Resnick of Disability Rights Pennsylvania in Philadelphia.
