State Farm Fire & Casualty Co. seeks more than $150,000 from Dolan's Appliance Service

PHILADELPHIA – An insurance company is seeking damages after it paid a claim for water damage allegedly caused by leaking dishwasher.

State Farm Fire & Casualty Co., as subrogee of Lee Zoeller, filed a complaint on Dec. 29, 2017, in the U.S. District Court for the Eastern District of Pennsylvania against Dolan's Appliance Service alleging negligence and other counts.

According to the complaint, the plaintiff provided homeowners insurance to Zoeller for a Phoenixville property. The plaintiff states the Zoeller property was damaged in August 2017 because of a water leak allegedly caused by the defendant's installation of a dishwasher. The plaintiff alleges the water damage totaled more than $150,000.

The plaintiff holds Dolan's Appliance Service responsible because the defendant allegedly failed to service and reinstall the dishwasher in an appropriate manner.

The plaintiff seeks judgment against the defendant in an amount of more than $150,000, delay damages, interest, court costs and any further relief the court grants. It is represented by Daniel J. de Luca and Meghan Micciolo of de Luca Levine LLC in Blue Bell.
