Resource I Construction Services alleged to owe contributions to fund

PHILADELPHIA – The board of trustees of a pension fund allege that an Elkins Park employer has failed to remit contributions.

The boards of trustees of the Laborers' District Council Construction Industry Pension and Annuity Fund, et al. filed a complaint on Jan. 9 in the U.S. District Court for the Eastern District of Pennsylvania against Resource I Construction Services citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the defendant has failed to submit remittance reports and failed to pay contributions and deductions due since Sept. 22, 2017.

The plaintiffs hold Resource I Construction Services responsible because the defendant allegedly breached their bargaining agreement by failing to submit the reports and pay contributions.

The plaintiffs seek all unpaid contributions, interest, audit fees, court costs, liquidated damages, penalties, and any further relief the court grants. They are represented by Joe P. Trigiani of Cleary, Josem & Trigiani LLP in Philadelphia.
