F.N.B. Corp. claims First National of Nebraska is infringing trademark

PITTSBURGH – A Pittsburgh-based banking and financial services company claims that a Nebraska corporation is unlawfully using its mark.

F.N.B. Corp. filed a complaint on Jan. 17 in the U.S. District Court for the Western District of Pennsylvania against First National of Nebraska Inc. alleging trademark infringement and other counts.

According to the complaint, the plaintiff is the owner of the FNB marks and has registered them. It alleges the defendant is using infringing mark FNBO for competing banking services.

The plaintiff holds First National of Nebraska Inc. responsible because the defendant allegedly used a confusingly similar trademark.

The plaintiff requests a trial by jury and seeks to enjoin the defendant from further using plaintiff's trademark, accounting and payment of all profits gained by the defendant, monetary damages, court costs and any further relief the court grants. It is represented by Scott D. Cessar and Audrey K. Kwak of Eckert Seamans Cherin & Mellott LLC in Pittsburgh.
