Securitas Security Services USA Inc. guard alleges she wasn't reinstated after maternity leave

PHILADELPHIA – A Philadelphia woman alleges her Conshohocken employer failed to reinstate her to her position after taking a maternity leave.

Mercedes Dowe filed a complaint on Feb. 2 in the U.S. District Court for the Eastern District of Pennsylvania against Securitas Security Services USA Inc. citing the Family and Medical Leave Act and the Pennsylvania Human Relations Act.

According to the complaint, the plaintiff alleges that in 2014, she was hired as a security officer by the defendant. The suit states in December 2015, the plaintiff notified her supervisor that she was pregnant and she was immediately removed from the schedule and told she needed to file for FMLA leave. The suit states her FMLA leave was approved in January 2016 with a scheduled leave date in March. She alleges she was returned to the schedule and worked until she was scheduled to take her leave.

She alleges she faxed a return to work form in May 2016, but she was never contacted to return to work. She alleges she never received a termination letter or told she was terminated.

The plaintiff holds Securitas Security Services USA Inc. and responsible because the defendants allegedly failed to reinstate her and constructively terminated her position.

The plaintiff requests a trial by jury and seeks compensatory damages, back pay, front pay, past lost wages, future wages, lost pay increases, lost pay incentives, lost opportunity, lost benefits, punitive damages, court costs, interest, delay damages and any further relief the court grants. She is represented by Graham F. Baird of Law Offices of Eric A. Shore PC in Philadelphia.
