Susquehanna Auto Inc. alleges Columbia individual is using infringing mark for business

HARRISBURG – A Wrightsville Chrysler, Dodge, Jeep and Ram sales and service dealer alleges a Columbia individual is using a similar mark for his business.

Susquehanna Auto Inc. filed a complaint on Feb. 7 in the U.S. District Court for the Middle District of Pennsylvania against Donald Hughes Jr. alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it has used the Susquehanna mark as a dominant part of its trade name since 2002. The suit states the defendant is operating an automobile repair and service business under the name Susquehanna Automotive approximately 2 miles from the plaintiff's location.

The plaintiff holds Hughes, Jr. responsible because the defendant allegedly used a confusingly similar mark as the plaintiff which creates a likelihood of confusion and deception to consumers.

The plaintiff seeks enjoin the defendant from further using plaintiff's trademark, all profits, damages, compensatory damages, court costs and any further relief the court grants. It is represented by James J. Rodgers and John B. Consevage of Dilsworth Paxson LLP in Harrisburg.
