Ingram Barge Co. LLC seeks damages over Ohio River barge breakaway

PITTSBURGH – A Nashville, Tennessee company alleges its barges were damaged in a breakaway on the Ohio River.

Ingram Barge Co. LLC filed a complaint on Feb. 8 in the U.S. District Court for the Western District of Pennsylvania against Borghese Lane LLC, McKees Rocks Harbor Services LLC and Industry Terminal and Salvage Co. alleging general maritime negligence and other counts.

According to the complaint, the plaintiff owned or was charterer of several loaded inland river covered hopper cargo barges on the Ohio River and that the barges were part of a fleet operated by the defendants. It alleges these barges were damaged in a breakaway on Jan. 13.

The plaintiff holds Borghese Lane LLC, McKees Rocks Harbor Services LLC and Industry Terminal and Salvage Co. responsible because the defendants allegedly failed to ensure the safety and security of the barges under their control and their alleged negligence caused the barges to break free and be carried downriver.

The plaintiff seeks actual damages, court costs, interest and any further relief the court grants. It is represented by Holly M. Whalen of Cipriani & Werner PC in Pittsburgh and Todd M. Powers and Megan A. Sullivan of Schroeder, Maundrell, Barbiere & Powers in Mason, Ohio.
