Gardens Group Development alleges Malvern companies breached duty

PITTSBURGH – A Florida company has filed suit against an individual and three companies based in Malvern over allegations it was deprived financial opportunities relating to the acquisition of properties in Pittsburgh.

Gardens Group Development LLC filed a complaint on Feb. 22 in the Court of Common Pleas of Allegheny County against David M. Turner, Carson DevCo LLC, 1700 Partners LLC and 1720 Partners LLC alleging breach of fiduciary duty and other counts.

According to the complaint, the plaintiff and Turner were partners in a real estate purchase in Pittsburgh. After closing on the property, the suit states Turner did not offer the plaintiff any interest in the defendant limited liability companies that were created to purchase the properties.

The plaintiff holds Turner, Carson DevCo LLC, 1700 Partners LLC and 1720 Partners LLC responsible because the defendants allegedly excluded the plaintiff from ownership of the properties and failed to act loyally to the plaintiff.

The plaintiff seeks judgment against the defendants in compensatory damages of more than $35,000, interest, court costs and any further relief the court grants. It is represented by David A. Strassburger and Jordan L. Strassburger of Strassburger McKenna Gutnick & Gefsky in Pittsburgh.
