SCRANTON — Two individuals are suing Architectural Polymers Inc. and AP Thermoforming LLC for allegedly failing to properly compensate them for their work.

David Pereira and Rodney S. Steward filed a complaint on March 8 in the U.S. District Court for the Middle District of Pennsylvania, alleging that the defendants failed to fairly compensate them for their work.

According to the complaint, the plaintiffs allege that they worked as non-exempt employees for more than 40 hours per week, but they allegedly were not properly paid for commuting to a work site. The plaintiffs hold the defendants responsible for allegedly failing to pay drive time at $12.25 per hour for travel in the company vehicle from the office to a work site.

The plaintiffs request a trial by jury and seek all drive time hours, overtime pay, court costs, liquidated damages, punitive damages and any further relief this court grants. They are represented by Armin Feldman of Armin Feldman, Esquire in Lehighton, Pa.
