Patenaude & Felix APC letter allegedly fails to inform consumers how to properly dispute debt

PITTSBURGH – An Allegheny County consumer alleges a letter sent to her by a debt collector contains confusing statements.

Karen Schultz filed a complaint on behalf of herself and all others similarly situated on March 9 in the Court of Common Pleas of Allegheny County against Patenaude & Felix APC citing the Fair Debt Collection Practice Act.

According to the complaint, the plaintiff alleges that she received a collection letter from the defendant that failed to inform her that a dispute of an alleged debt should be done in writing.

The plaintiff holds Patenaude & Felix APC responsible because the defendant's collection letter allegedly would confuse the least sophisticated consumer as to the effective method to dispute a debt.

The plaintiff requests a trial by jury and seeks statutory damages, court costs and any further relief the court grants. She is represented by Clayton S. Morrow of Morrow & Artim PC in Pittsburgh and Jeffrey L. Suher of Dell, Moser, Lane & Loughney LLC in Pittsburgh.
