PHILADELPHIA — Two individuals have filed a class-action lawsuit against Eagle Diner Corp., James Rokos, Maria Rokos and Marko Rokos for allegedly failing to properly pay them for working overtime.
Alexis Flores and Virginia Goold filed a complaint on March 22 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants failed to pay them fair wages for their work.
According to the complaint, the plaintiffs allege that they frequently worked more than 40 hours per week, but they allegedly were not paid any overtime wages. The plaintiffs hold the defendants responsible for allegedly instructing their servers, including the plaintiffs, to clock out while they were still working in order to avoid recording all their working hours and avoid paying overtime.
The plaintiffs request a trial by jury and seek overtime wages, compensatory damages, liquidated damages, interest, court costs, equitable and injunctive relief and any further relief this court grants.
