American Education Services accused of breach of contract

PHILADELPHIA — Two individuals have filed a class action lawsuit against Pennsylvania Higher Education Assistance Agency d/b/a Fedloan Servicing d/b/a American Education Services for alleged breach of contract and violation of state and federal laws.

Daniel Keegan and Shon Meckfessel filed a complaint on March 19 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants placed borrowers into loan deferment who allegedly neither applied for nor met the criteria for that status.

According to the complaint, the plaintiffs allege that they were damaged due to allegedly being induced into participating in the Public Service Loan Forgiveness and Teacher Education Assistance for College and Higher Education programs. The plaintiffs hold the defendant responsible for allegedly making false representations about the programs in order to induce them into participating.

The plaintiffs request a trial by jury and seek punitive and treble damages, an injunction against the defendant, court costs, disgorgement, restitution, court costs and any further relief this court grants. They are represented by Peter D. St. Phillip, Christian Levis, Roland R. St. Louis III and Matthew Acocella of Lowey Dannenberg P.C. in White Plains, N.Y.
