KB Logistics LLC allegedly failed to comply with contract

PHILADELPHIA — A company is suing KB Logistics LLC for alleged breach of contract.

Northeast Building Products Corporation filed a complaint on April 23 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant violated the terms of an agreement.

According to the complaint, the plaintiff alleges that the defendant agreed to deliver its products for a flat rate for one year unless fuel prices went above $4 per gallon. The plaintiff holds the defendant responsible for allegedly refusing to honor the agreed-upon rate and wrongfully attempting to impose surcharges that allegedly are not permitted under the contract.

The plaintiff requests a trial by jury and seeks to no longer be bound by the agreement, plus compensatory damages, the costs of this action and any other just and equitable relief. The plaintiff is represented by Theodore H. Jobes of Fox Rothschild LLP in Philadelphia.
