PHILADELPHIA — A Philadelphia resident is suing Facebook Inc., Instagram Inc. and Instagram LLC for false advertising.
Kristel Oreto filed a complaint June 7 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants breached its duty of good faith and fair dealing.
According to the complaint, Oreto suffered significant emotional distress and damage to her reputation as a result of false and misleading endorsements for products that used her name, picture and trademark without her consent. The plaintiff said those endorsements were approved and published by the defendants on their websites.
Oreto claims Facebook and Instagram are responsible because they allegedly refused to investigate or follow their own advertising policies and procedures for approving advertisements.
The plaintiff requests a trial by jury and seeks a judgment against defendants for consequential and general damages, costs of the suit and further relief as the court may deem just. She is represented by Robert R. Axenfeld of Axenfeld Law Group LLC in West Chester, Pennsylvania.
