Software company alleges its website was copied by Resolute Innovation

PITTSBURGH — A software technology company is suing Resolute Innovation Inc., citing alleged breach of contract and unjust enrichment.

Wellspring Worldwide Inc. filed a complaint June 8 in the U.S. District Court for the Western District of Pennsylvania, claiming the defendant violated the Computer Fraud and Abuse Act.

According to the complaint, the plaintiff was informed on May 7 that Resolute was scraping a Flintbox website that was causing heavy web traffic and causing database servers to crash. Despite sending the defendant a cease-and-desist letter to stop the scraping and copying of Flintbox's Terms of Use or intellectual property rights, the suit alleges that legal counsel for defendant refused to respond in writing to the letters. 

As a result, Wellspring said website crashes have impaired the integrity and availability of the Flintbox website, and Wellspring has allegedly lost at least $5,000 in value. 

The plaintiff claims Resolute intentionally accessed Wellspring's protected computers without or in excess of authorization and obtained information not intended to be viewed by third-party companies.

The plaintiff requests a trial by jury and seeks judgment for compensatory damages, a permanent injunction, costs and disbursements and other relief the court deems just and appropriate. It is represented by Bruce Rende of Robb Leonard Mulvihill LLP in Pittsburgh, Pennsylvania.
