Dental Imaging claims Global Industrial changed product without consent

PITTSBURGH — A dental equipment provider is suing parts manufacturer and supplier Global Industrial Components Inc., citing alleged breach of contract and breach of warranty.

Dental Imaging Technologies Corp. filed a complaint July 3 in the U.S. District Court for the Western District of Pennsylvania, alleging that Global Industrial changed its manufacturing process for spring links to a wire cutting process from a stamping process without telling the plaintiff.

According to the complaint, Dental Imaging discovered the change in the defendant's manufacturing process for its x-ray system between July 2014 and Aug. 27, 2014, allegedly resulting in product recalls and significant costs.

Dental Imaging said it told Global Industrial about the damage caused by the unapproved change, but the defendant has not made any payment to compensate the plaintiff for its alleged corrective actions.

The plaintiff said it holds Global Industrial responsible because the defendant allegedly violated the terms of the parties' quality, supply and purchase agreements.

The plaintiff requests a trial by jury and seeks damages to be determined at trial, interest, costs and fees, attorney's fees and other relief as may be warranted under the circumstances. It is represented by Clem Trischler of Pietragallo Gordon Alfano Bosick and Raspanti LLP in Pittsburgh.
