Pedestrian sues Borough of Darby after tripping

MEDIA — A pedestrian is suing Borough of Darby, citing alleged negligence.

John De Angelo filed a complaint on Sept. 26 in the Delaware County Court of Common Pleas against the defendants alleging they failed to properly maintain the walking surfaces at or near their premises.

According to the complaint, the plaintiff alleges that on Nov. 21, 2016, he was walking at defendant's premises at or near 44 S. Seventh St. in Darby when he was caused to slip, trip and fall due to an uneven walking surface. He sustained serious and permanent orthopedic and neurological injuries. The plaintiff holds Borough of Darby, et al, responsible because the defendants negligently permitted the walking surface to become and to remain broken or uneven and failed to give adequate warning or notice of the existing danger.

The plaintiff seeks judgment against defendants, jointly and severally, for damages in excess of $50,000. He is represented by Louis Himmelstein and Brett Walker of Louis B. Himmelstein & Associates PC in Philadelphia.
