Delco plaintiff suing Royal Farms, says gas sprayed from hose into his eyes

MEDIA — A patron is suing Two Farms Inc., d/b/a Royal Farms, a gas station operator, citing alleged negligence and premises liability.

Anthony Mlodzianowski filed a complaint on Oct. 12 in the Delaware County Court of Common Pleas against Two Farms Inc., d/b/a Royal Farms, alleging that the gas station operator failed to maintain the fuel pump hose in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on Jan 5, 2017, he was using the fuel pump at defendant's gas station when gasoline suddenly and without warning sprayed into his eyes and onto the ground. 

He says he suffered serious and permanent injuries to his right knee and eyes, resulting in pain and suffering, agony and inconvenience. The plaintiff holds Two Farms Inc., d/b/a Royal Farms, responsible because the defendant allegedly failed to provide adequate warning of the unreasonably dangerous condition of the fuel pump and failed to take the defective fuel pump out of service.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount in excess of $50,000, plus interest and costs. He is represented by Justin Bernstein of Kenneth R. Schuster & Associates PC in Media.
