Employee accuses Rand Corp. of gender and racial discrimination

PITTSBURGH — An African-American woman is suing Rand Corp., her employer, citing an alleged violation of the Equal Pay Act and gender and racial discrimination.

Stacey Gallaway filed a complaint on Oct. 16 in the U.S. District Court for the Western District of Pennsylvania against Rand Corp., alleging the employer discriminated against her in compensation, terms, conditions and privileges of employment because of her sex and race. 

According to the complaint, the plaintiff alleges that between June 2017 and Dec. 11, 2017, she began questioning why she was a Contract Administrator I when she performed work at a significantly higher level than the Contract Administrator I position and was paid less than similarly situated white male and black male employees. 

By December, she was promoted to a Contract Administrator II despite the fact she continued to perform Contract Administrator III work but continued to be paid less than similarly situated white men and white women who performed jobs requiring substantially similar skill, effort and responsibility, the suit says. The plaintiff holds Rand Corp. responsible because the defendant allegedly paid Gallaway less than the rates it paid white male and white female employees for the same work they performed.

The plaintiff requests a trial by jury and seeks full value of wages and benefits she would have received had it not been for defendant’s illegal treatment, with interest thereon, compensatory and punitive damages, costs and expenses of this litigation, and attorneys' fee. She further seeks for an order that defendant be permanently enjoined from discriminating or retaliating against her because of her race.
