Suit against former apartment manager accused of using proprietary information voluntarily dropped

PHILADELPHIA — A lawsuit filed by an apartment building operator against Elizabeth Gallaso, One Wall Partners LLC and Ron Kutas, former AION property manager and competitor, citing alleged violation of the Defend Trade Secrets Act, Computer Fraud and Abuse Act, Pennsylvania's Uniform Trade Secrets Act, and other counts was dismissed shortly after its filing.

AION Management LLC filed a complaint on Nov. 7, 2018 in the U.S. District Court for the Eastern District of Pennsylvania, and it was voluntarily dismissed two months later on Jan. 11, 2019, with prejudice and without costs to any party. 

The suit had alleged that AION's confidential information had been disclosed to Kutas. 

In an affidavit Kutas filed with the court on Jan. 10, he swore he had never received nor requested any AION trade secrets, and that in the future should he come into possession of such trade secrets he would "immediately (and) permanently delete any and all copies or excerpts thereof."

The U.S. District Court for the Eastern District of Pennsylvania Case No. is 2:18-cv-04825-JD.
