Fired COO sues Magemojo for breach of contract

PITTSBURGH — A fired chief operating officer is suing Magemojo LLC and others, citing alleged breach of employment agreement.

David Gitman filed a complaint on Nov. 26 in the Allegheny County Court of Common Pleas against the defendants, alleging they violated the Pennsylvania Wage Payment and collection Law.

According to the complaint, the plaintiff alleges that on Sept. 21, he was terminated from his employment without cause. He was caused to incur damages in excess of $63,572.59 for unpaid salary, paid time off and expenses and unpaid phantom equity interest in the amount of $214,500, the suit says. 

The plaintiff holds Magemojo LLC and others responsible because the defendants allegedly failed to pay severance benefits, unpaid salary, accrued PTO, expenses and phantom equity interest.

The plaintiff requests a trial by jury and seeks actual damages of not less than $63,572.59 and award for phantom equity interest of at least $214,500, punitive damages, costs, attorney's fees and all other just and proper relief. He is represented by Brian Benestad of HKM Employment Attorneys LLP in Pittsburgh.

The Allegheny County Court of Common Pleas Case No. is 18-15290.
